Higher Ground Learning Portal — End-User License Agreement & Terms of Use
Enrollment Caps and Procedures
Unless stated otherwise, course enrollments will be accepted on a first-come, first-serve basis. When a course reaches maximum class size, subsequent enrollments will be added to a waitlist. In the event of a large course requiring 2 or more instructors, students will be grouped according to initial diagnostic scores.
Courses require a minimum number of students enrolled in order to run. If a course fails to meet minimum enrollment by the registration deadline, the course will necessarily be rescheduled or cancelled as appropriate. In the event of a cancellation or postponement, the course fee will be transferred to the next course at this school, or refunded in full upon request.
SAT or ACT Exam Registration
Enrollment in this prep course DOES NOT register your student for the SAT or ACT Exam. Parents/Guardians are responsible for enrolling their student(s). Visit the College Board or ACT website for upcoming test dates and registration information. Registration for the test is on a first come first serve basis, so please register early to be guaranteed a seat.
Cancelled Enrollment Policy
Full refunds are available for courses purchased from highergroundlearning.com, highergroundprep.com, and hgl.co at any point up to 2 weeks before the course start date. You may cancel your course registration and receive a full refund or exchange it for another course of equal value. If you need to cancel within two weeks, you'll get an HGL Credit for use at any future HGL course or for any HGL 1-on-1 tutoring or similar program. All other returns or refunds for course registrations will be handled on a case-by-case basis. Refunds for online tutoring packages will be evaluated separately from course enrollments. There will be no refunds issued more than 10 days after the final day of classes for online tutoring packages. Cancellations of 1-on-1 lessons with fewer than 24 hours notice forfeit 30 minutes of tutoring time.
Summer Workshop Return Policy
University of Utah Youth Education refund requests and withdrawal from classes must be made through Youth Education, 1195 Annex Building, Wing A, or over the phone at 801-581-6984. Parents are responsible for dropping all desired courses for their children. A 100% refund will be given for cancellations up to two full weeks prior to the first day of class. No refunds will be authorized after that, including no prorated refunds for partial attendance. No refunds are authorized in the event of a dismissal. This End-User License Agreement and Terms of Use ("Agreement") governs your use of the Higher Ground Learning Portal (the "Portal"), the online registration and class-management service operated by Higher Ground Learning ("HGL," "we," "us"). By accessing or using the Portal — including registering a student for a class, joining a waitlist, purchasing tutoring hours, or signing in to a parent, student, counselor, or instructor account — you agree to this Agreement.
1. What the Portal is
The Portal is HGL's system for managing enrollment in our test-preparation classes and tutoring services. Through it, families can register students for classes, complete payment, receive class-related communications, and view enrollment details; school counselors and instructors can view information relevant to their role. The Portal is provided for these purposes only.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Portal for its intended purpose. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of any part of the Portal, and you may not use the Portal to build a competing service.
3. Accounts and accuracy
You agree to provide accurate, current information when registering and to keep it up to date. Sign-in links and codes sent to your email address are for your use only; you are responsible for activity that occurs through your access. Notify us at info@highergroundlearning.com if you believe your access has been used without authorization.
4. Payments and refunds
Payments are processed by Stripe, our third-party payment processor; HGL does not store your full card details. Prices for classes and tutoring packages are shown at checkout. Refunds and cancellations are handled according to the policies communicated at registration and in our FAQs; where a class is cancelled by HGL, we will contact you about a refund or alternative. Accounting records of transactions are maintained in our bookkeeping systems.
5. Acceptable use
You agree not to misuse the Portal — including attempting to access accounts or data that are not yours, interfering with the Portal's operation, submitting false registrations, or using the Portal for any unlawful purpose. We may suspend or terminate access that violates this Agreement.
6. Communications
Registration involves transactional emails (confirmations, class logistics, schedule changes) that are part of the service. Non-essential emails include an opt-out. See our Privacy Policy for details on how we handle contact information.
7. Privacy
Our collection and use of personal information is described in our Privacy Policy, available on our website. By using the Portal you consent to that policy.
8. Intellectual property
The Portal, our course materials, and all related content are the property of Higher Ground Learning or its licensors and are protected by applicable intellectual-property laws. Nothing in this Agreement transfers any ownership to you.
9. Third-party services
The Portal relies on third-party services (including payment processing, email delivery, and hosting). We are not responsible for interruptions or issues originating with those services, though we will make reasonable efforts to keep the Portal available and functioning.
10. Disclaimers
The Portal is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Portal will be uninterrupted or error-free. Nothing in this section limits any warranties or rights regarding the educational services themselves that cannot be excluded under applicable law.
11. Limitation of liability
To the fullest extent permitted by law, HGL will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Portal. Our total liability for claims relating to the Portal will not exceed the amount you paid to HGL through the Portal in the twelve months preceding the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Changes
We may update the Portal and this Agreement from time to time. The "Last updated" date above reflects the current version. Material changes will be posted on this page; continued use of the Portal after changes take effect constitutes acceptance.
13. Termination
You may stop using the Portal at any time. We may suspend or terminate Portal access for violation of this Agreement. Sections that by their nature should survive termination (including 8, 10, and 11) will survive.
14. Governing law
This Agreement is governed by the laws of the jurisdiction in which Higher Ground Learning is established, without regard to conflict-of-law rules.
